EMINENT DOMAIN ERODING PRIVATE PROPERTY RIGHTS
The abuses never end. Now, Bart Didden, who has owned property for 48 years, is in the midst of a real problem. He wanted to give CVS Pharmacy a 25 year lease. Then, another pharmacy asked for 50% of the deal, with the threat of going to the city and having the property condemned. While this goes beyond Eminent Domain and amounts to extortion, the city is going along with the idea of condemning the property so that a competitive drug store can occupy the space. This unbelievable example of abuse is possible because courts throughout the country are condoning this type of action. If there are similar problems within your Association, please let us know.
